I John ELGAR of the Town of Folkestone in the County of Kent Gentleman do hereby revoke all Wills Codicils and Testamentary dispositions herebefore made by me and declare this to be my last will and testament - I appoint my dear wife Alice and my Friend James REYNOLDS of the town of Folkestone aforesaid linen Draper and my Brother in Law James JEFFERY of Beer Farm in the Parish of St Margarets near Dover in the said County Farmer Executrix and Executors of this my Will and I also appoint my said wife during her widowhood and the said James REYNOLDS and James JEFFERY Guardians of my children during their minority I Give and Bequeath untomy said wife Alice all the household goods furniture books pictures prints plate linen china glass wine liquors housekeeping stores and provisions and other moveable effects of a like nature for her own absolute use and benefit I give and devise all the real estate vested in me as mortgage or Trustee unto the said James REYNOLDS and James JEFFERY and their Heirs and Assigns subject to the equities and trusts affecting the same I give and devise all my freehold and copyhold messuages lands tenements hereditaments and real estate whatsoever and wheresoever in possession reversion remainder or expectancy with their appurtenance (except mortgage and trust estates) unto and to the use of the said James REYNOLDS and James JEFFERY their Heirs and Assigns Upon trust that they the said James REYNOLDS and James JEFFERY or the survivor of them or the Heirs of such survivor their or his assigns or other the trustees or trustee of this my Will for the time being do and shall sell the same messuages or tenements lands and hereditaments together or in parcels by public auction or private contract at such place or places time or times and subject to such special or other stipulations relative to the title or the evidence of title or the manner and costs investigating such title on the payment of the purchase money or to any other matter connected with the Sale as my Trustees or Trustee for the time being shall think fit or as their or his Counsel shall advise with full discretion and authority to sell either subject to or discharged from or with an indemnity (by impounding part of the purchase money or otherwise) against incumberances and also to fix a reserved bidding and buy in any lot or lots at any auction and to second or vary the terms or any contract without being liable for any consequent loss And also to execute such instruments and assurances as shall be thought requisite for effecting and completing any such sale And also do and shall if they or he shall think fit raise money upon mortgage of my said Estates or any of them until the same shall be sold And also do and shall if they or he shall think fit previously to any such sale as aforesaid of any hereditaments whereof an undivided share is hereby devised make partition of such hereditament with liberty to give and pay out of any trust monies which shall come to their or his hands under this my will to accept any sum or sums of money for equality of partition and to execute such instruments and assurances as shall be thought requisite for effectuation and completing any such partition And I direct that the monies to arise from any such sale mortgage or partition shall be received by my said trustees or trustee for the time being and be applied in the manner hereafter expressed And I declare that my said trustees or trustee for the time being shall be at liberty to postpone the sale of my said hereditaments and Estate or any of them until the produce shall become distributable among my children under the trusts hereinafter contained or for any shorter period if such postponement shall appear to them to be advantageous and during the suspense of the sale thereof to let the same from year to year or for any term not exceeding seven(?) years in possession of ? rent and their or his option to take possession thereof and to manage and improve the same and for that purpose to employ Agents bailiffs and Servants and expend a comp? part of my trust monies And I declare that notwithstanding the postponement of the Sale of my real estates or any of them the same shall for the purposes of enjoyment and ?be considered in equity as ? into? From the time of my decease And I give and Bequeath unto the said James REYNOLDS And James JEFFERY their Executors Administrators and Assigns the residue of my personal Estate upon trust that they the said trustees hereby named or the survivor or their or his assigns or other the trustees or trustee of this my will for the time being do and shall as soon after my decease as they or he shall think expedient call in dispose of and convert the same into money and to receive the money to arise therefrom And I do hereby declare that my trustees or trustee or other the trustees or trustee for the time being of this my will shall stand and be possessed of the money to arise from my residuary personal estate and also of the money to arise from the sale mortgage or partition of my freehold copyhold and real estate Upon trust that they the said trustees or trustee for the time being do and shall with and out of the said monies pay satisfy and discharge all my just debts funeral and testamentary expences and the Legacies which I shall by this my Will or my Codicil hereto bequeath and do and shall invest the residue of the said monies after answering the purposes aforesaid in their or his names or name in the parlimentary funds of Great Britain or in Government or real securities in England and from time to time alter vary and transpose the said trust monies or any part thereof for into or upon other funds and securities of the like nature at their or his discretion And I do hereby declare that the said Trustees or Trustee for the time being shall stand possessed of the said trust monies funds and securities and the interests dividends and annual produce thereof Upon and for the trusts intents and purposes hereinafter declared concerning the same that is to say Upon trust to pay the interest dividends and annual produce of the said trust monies funds and securities unto or permit the same to be received by my said dear wife Alice during her life that she shall so long continue my Widow And from and after the decease or marriage of my said wife I direct that the said Trustees and Trustee for the time being shall stand possessed of the said trust monies funds and securities and the interest dividends and annual produce thereof Upon trust for the absolute use of my child if only one or all my children equally if more than one who being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain that age or marry provided always and I do hereby declare that after the decease or marriage of my said wife and during such time as my said children or any of them being a son or sons shall be under the age of twenty one years or being a daughter or daughters shall be under that age and unmarried the said trustees or trustee for the time being shall appropriate all or a competent part of the Interest dividends and annual produce of the share to which each such Child shall be for the time being entitled under the trusts hereinbefore contained for or towards his or her maintenance education advancement accumulating the unapplied income and adding the accumulation to the same share. Provided also and I do hereby further declare that it shall be lawful for the trustees or trustee for the time being at any time or times during the life and widowhood of my said wife with her consent and after her decease or marriage at their or his discretion to raise and apply the whole or any part of the share to which each such child shall for the time being be entitled under the trusts hereinbefore contained for or towards his or her better education preferment advancement or benefit And I hereby declare that the receipts of my said Trustees or Trustees for the time being for any money payable to them to them or him by virtue of this my Will shall effectually discharge the person or persons paying the same from being a? or accountable for the misapplication or non application thereof or from being obliged to see to the application thereof or to enquire into the necessity or propriety of any sale that may be made under or by virtue of this my will Provided also and I do further declare that if my said trustees or either of them or any person or persons to be appointed under this clause shall die or be unwilling or incompetent to execute the trusts of my will it shall be lawful for the competent Trustees or Trustee for the time being (if any whether retiring from office of Trustee or not if none) for the Executors or Administrators of the last surviving trustee to substitute by any writing under their his or her hands or hand any fit person or persons in which and in whose Heirs Executors or Administrators alone (or as the case may be) jointly with the surviving or continuing trustees or trustee and their or his Executors and Administrators my ?estates shall be vested And Ihereby lastly declare that my present and future trustee of my will shall not be accountable for more money than he or she shall actually receive and any one of my said trustees or trustee for the time being shall not be responsible for the others or other of them or for the signing receipts for the sake of conformity or for any involuntary losses and that it shall be lawful for them him and her out of the monies which shall come to their his or her hands or hand respectfully to reimburse themselves himself and herself and their his or her cotrustees and cotrustee their his and her costs charges and expenses in discharging and performing the several trusts powers and authorities hereby respectfully re????
